All services are subject to the agreed project scope, deliverables, pricing, and timeline outlined in the relevant proposal or service agreement.

2. Payment Terms

By purchasing our services, you agree to pay the fees specified in your proposal, quotation, or service agreement.

• Payment schedules and methods will be communicated before the project begins.

• Any required advance payment must be received before work commences.

• Additional services or requests outside the agreed scope may incur additional charges.

• Work may be paused if scheduled payments are not received.

• Any applicable third-party expenses, including publishing platform fees, advertising budgets, stock assets, or distribution costs, will be communicated separately.

3. Ownership & Copyright

Clients retain ownership of their original manuscripts, concepts, and materials supplied to Orbex Bookmark.

Upon receipt of full payment, ownership rights in the original custom deliverables created specifically for the client will be transferred to the client, subject to any applicable third-party licenses, platform terms, and other legal restrictions.

Orbex Bookmark does not claim ownership of client-provided content. Clients are responsible for ensuring that all materials they supply are legally authorized for use.

Third-party fonts, stock images, software, and other licensed assets remain subject to their respective licensing conditions.

4. Client Responsibilities

Clients agree to:

• Provide accurate and complete project information.

• Supply necessary documents, manuscripts, images, and reference materials.

• Respond to questions and feedback requests within a reasonable timeframe.

• Review drafts, designs, and deliverables carefully.

• Ensure that supplied content does not infringe the rights of any third party.

• Obtain any permissions, licenses, or approvals required for their content.

Delays in providing information, approvals, or feedback may affect project timelines. Orbex Bookmark is not responsible for errors resulting from inaccurate or incomplete information supplied by the client.

5. Revisions & Feedback

Each project includes a defined number of revisions, as specified in the applicable proposal or service agreement.

• Clients should provide clear and consolidated feedback.

• Revisions must remain within the original agreed project scope.

• Additional revisions or substantial changes may incur extra charges.

• Requests that significantly change the original concept, content, or project requirements may be treated as new work.

6. Confidentiality

Orbex Bookmark respects the confidentiality of client information, manuscripts, business details, and project materials.

We will take reasonable measures to protect confidential information and will not disclose it to unauthorized parties without the client’s consent, except where disclosure is required by law.

Client materials will only be accessed and used as necessary to provide the agreed services.

7. Delivery Timelines

We aim to complete projects within the estimated timelines communicated to clients.

However, delivery dates are estimates and may be affected by:

• Project complexity and scope.

• Delays in receiving client materials or feedback.

• Additional revision requests.

• Technical issues or third-party platform delays.

• Circumstances beyond our reasonable control.

We will communicate significant delays and work with clients to establish revised timelines where necessary.

8. Publishing Platforms & Distribution

Orbex Bookmark may assist clients with publishing and distribution through platforms such as Amazon KDP, IngramSpark, and other relevant retailers.

However:

• Publishing platforms operate independently and have their own policies and requirements.

• Final approval, listing availability, distribution, pricing, and royalty decisions may be controlled by the respective platforms.

• Orbex Bookmark does not guarantee platform approval, uninterrupted distribution, or specific publishing outcomes.

• Clients are responsible for reviewing and approving final publishing details, including book content, pricing, metadata, and rights information.

9. Marketing & Performance Disclaimer

Orbex Bookmark provides author branding, book marketing, promotional content, and digital marketing services.

While we work to improve book visibility and promotional performance, we do not guarantee specific results, including:

• Book sales or revenue.

• Bestseller rankings or chart placements.

• Reviews, ratings, or reader engagement.

• Advertising conversions or return on investment.

• Media coverage or audience growth.

Marketing results depend on several factors, including market demand, competition, budget, audience behavior, and third-party platform algorithms.

10. Limitation of Liability

Orbex Bookmark will make reasonable efforts to provide professional services in accordance with the agreed project scope.

To the extent permitted by applicable law, Orbex Bookmark will not be liable for indirect, incidental, special, or consequential losses arising from the use of our services.

We are not responsible for third-party platform decisions, interruptions, account restrictions, distribution changes, or outcomes outside our reasonable control.

Nothing in these terms excludes liability that cannot legally be excluded under applicable law.

11. Refund & Cancellation Policy

Due to the customized nature of our services, cancellation and refund requests will be reviewed based on the project’s progress and the terms agreed upon before work begins.

• Cancellation requests must be submitted in writing.

• If a project is cancelled before work begins, any refund will be determined according to the applicable agreement and any costs already incurred.

• Once work has commenced, completed work, committed resources, and non-recoverable expenses may be deducted from any eligible refund.

• Completed and approved deliverables are generally not eligible for refunds.

12. Termination of Services

In the event of termination, the client remains responsible for payment for work completed and expenses incurred up to the termination date, subject to the applicable agreement.

Clients agree to indemnify and hold Orbex Bookmark harmless from claims, liabilities, damages, and expenses arising from:

• Copyright or intellectual property infringement involving client-provided materials.

• Unauthorized use of third-party content.

• False, misleading, or unlawful information supplied by the client.

• Legal disputes arising from the client’s book content or publishing rights.

This provision applies to the extent permitted by applicable law.

14. Website Use
